Question 7 - What If the IRS Does not Respond

By the Due Date of Our Annual Return?

A. If the IRS has not responded to your Form 8940 reclassification request by the due date of Form 990-PF (May 15, for calendar year organizations; 15th day of fifth month after the close of the year for fiscal year organizations), you can apply for an automatic six month extension, using IRS Form 8868.  Be sure to file Form 8868 before your return's due date and to mail your extension form using registered or certified mail (or electronically) so you can prove the date you sent it in.
